Drawing on fresh archival evidence, this book tells the story of how experts, cartels and international organizations have written the rules for Europe since around 1850. It shows that the present-day European Union was a latecomer in European integration, which is embedded in a long-term technocratic internationalist tradition.

Europe’s Infrastructure Transition

Europe's critical infrastructure is a key concern to policymakers, NGOs, companies, and citizens today. A 2006 power line failure in northern Germany closed lights in Portugal in a matter of seconds. Several Russian-Ukrainian gas crises shocked politicians, entrepreneurs, and citizens thousands of kilometers away in Germany, France, and Italy. This book argues that present-day infrastructure vulnerabilities resulted from choices of infrastructure builders in the past. It inquires which, and whose, vulnerabilities they perceived, negotiated, prioritized, and inscribed in Europe's critical infrastructure. It does not take 'Europe' for granted, but actively investigates which countries and peoples were historically connected in joint interdependency, and why. In short, this collection unravels the simultaneous historical shaping of infrastructure, common vulnerabilities, and Europe. The Making Europe series was awarded the Freeman Award by the European Association for the Study of Science and Technology (EASST) in 2014, in recognition of its significant contribution to the interaction of science and technology studies with the study of innovation.

Pollution, resource depletion, habitat management, and climate change are all issues that necessarily transcend national boundaries. Accordingly, they and other environmental concerns have been a particular focus for international organizations from before the First World War to the present day. This volume is the first to comprehensively explore the environmental activities of professional communities, NGOs, regional bodies, the United Nations, and other international organizations during the twentieth century. It follows their efforts to shape debates about environmental degradation, develop binding intergovernmental commitments, and—following the seminal 1972 Conference on the Human Environment—implement and enforce actual international policies.

Scholars have observed a gradual convergence of national European cartel laws towards EC competition law in recent years. Furthermore, most writers ascribe an important role in this convergence process To The influence of and pressure from the European Community. This is a remarkable conclusion considering the diversity that could be noticed only decades ago And The fact that the European Community has taken no direct legal action to harmonise national competition laws. These observations give rise to two questions: First, what is the extent of this convergence process and on which aspects do differences persist? Secondly, what have been the driving forces behind this development, and especially, what has been the role of the European Community in it? The study concentrates on three countries, namely Germany, Austria, And The Netherlands, which represented different models only some decades ago. The book aims at providing more insight into the development of competition policy in the EC and into the adaptation of national regulatory policy to EC law in general. This book is of interest to lawyers, political scientists, and economists working in the field of competition policy, As well as to scholars interested in European integration in general.

EU Competition Law and Economics

This is the first EU competition law treatise that fully integrates economic reasoning in its treatment of the decisional practice of the European Commission and the case-law of the European Court of Justice. Since the European Commission's move to a "more economic approach" to competition law reasoning and decisional practice, the use of economic argument in competition law cases has become a stricter requirement. Many national competition authorities are also increasingly moving away from a legalistic analysis of a firm's conduct to an effect-based analysis of such conduct, indeed most competition cases today involve teams composed of lawyers and industrial organisation economists. Competition law books tend to have either only cursory coverage of economics, have separate sections on economics, or indeed are far too technical in the level of economic understanding they assume. Ensuring a genuinely integrated approach to legal and economic analysis, this major new work is written by a team combining the widely recognised expertise of two competition law practitioners and a prominent economic consultant. The book contains economic reasoning throughout in accessible form, and, more pertinently for practitioners, examines economics in the light of how it is used and put to effect in the courts and decision-making institutions of the EU. A general introductory section sets EU competition law in its historical context. The second chapter goes on to explore the economics foundations of EU competition law. What follows then is an integrated treatment of each of the core substantive areas of EU competition law, including Article 101 TFEU, Article 102 TFEU, mergers, cartels and other horizontal agreements and vertical restraints.
